New Delhi: Lt Governor of Delhi, VK Saxena has sanctioned prosecution of two activists of “Youth Equality Foundation” and “Araksha Pradaj Party” for insulting the Constitution in a protest on August 9, 2018, a source said on Tuesday.
Activists Krishan Mohan Rai and Ashutosh Kumar among others raised slogans of “Arakshan Murdabad”, “Constitution Murdabad”, “SC/ST Act Murdabad”, “Ambedkar Murdabad” etc. and tore and burnt copies of the Constitution. Authorization under Section 196 of CrPC to prosecute accused persons in case FIR No. 75/2018 dated August 10, 2018 under various sections of C/ST (Prevention of Atrocities) Act, IPC and Prevention of Indignity. The National Honors Act will help police take the case to its logical conclusion by bringing the culprits to book, sources said.
The initial FIR was lodged in this regard based on the complaint of ‘Akhil Bharatiya Bhim Sena’ national in-charge Anil Tanwar.
The accused uploaded the protest videos on social media with the intention of promoting enmity between various groups, disrupting social harmony and disturbing peace. Others involved in the case against whom action has been taken include Abhishek Shukla, Srinivas Pandey, Santosh Shukla and Deepak Gaur. They were arrested and are out on bail granted by the Delhi High Court.
According to sources, the LG in his approval mentioned: “I have examined the FIR, charge sheet, relevant documents and other material placed on record and information of FIR No. 75/2018 dated 10.08.2018 at PS Parliament Street. , New Delhi.
“On careful scrutiny of the available evidence, I consider that a prima facie case has been made out against accused Krishan Mohan Roy. Indrajit Rai and Ashutosh Kumar S/o Sh. Naneshwar Prasad. WHEREFORE, prosecution under Section 196 of the Code of Criminal Procedure, 1973 for the trial of the above accused persons has been granted in FIR No. 75/2018 dated 10.08.2018, PS Parliament Street, for the said offence. “
